Who is responsible for your data

The data controller is Erica Bordin, HorsePower, Via Verdella 12, Savosa, Canton Ticino, Switzerland.

What data we collect

Data you give us directly. When you fill in a contact form, book a call or write to us by email, we collect your name, your email address, and whatever you choose to write in your message. If you book a session, we also collect the information needed to schedule and invoice it.

Data collected automatically. Like almost every website, this site records technical data when you visit: IP address, browser type, device, pages viewed and time spent. This data is used in aggregate form to understand how the site is used.

Data you give us during a coaching engagement. What is said in a coaching session is confidential and is governed by the ICF Code of Ethics, not by this policy. We keep only the minimum notes needed to work well, and we never share them.

Why we process it, and on what basis

To reply to you. If you write to us, we use your data to answer. The legal basis is the pre-contractual relationship you have initiated.

To deliver the services you have asked for. Coaching, mentor coaching, consulting or training. The legal basis is the contract between us.

To meet legal and accounting obligations. Invoicing and record keeping, as Swiss law requires.

To keep the site working and secure. The legal basis is our legitimate interest in running a site that functions.

We do not use your data for automated decision-making or profiling, and we never sell it.

The tools we use

Squarespace hosts this website and handles the contact forms. Squarespace Ireland Ltd. acts as our data processor.

Calendly is used to book calls. When you book, Calendly collects your name, email address and the time slot you choose.

Email. Our correspondence with you sits in our email provider's servers.

Each of these providers has its own privacy policy, which applies in addition to this one.

Cookies

This site uses only the cookies strictly necessary for it to work, plus Squarespace's own basic analytics cookies. We do not use advertising cookies and we do not track you across other websites.

You can block or delete cookies from your browser settings at any time. Some parts of the site may stop working properly if you do.

How long we keep your data

Enquiries that do not lead to a working relationship: two years, then deleted.

Client records and accounting documents: ten years, as Swiss law requires.

Coaching notes: for the duration of the engagement and for three years afterwards, then deleted.

Technical site data: as long as Squarespace retains it under its own policy.

Who your data is shared with

Your data is not shared with anyone other than the technical providers listed above, our accountant, and any authority entitled to request it by law.

When we work on a project alongside a partner, we tell you before the project starts who will be involved and what they will see.

Transfers outside Switzerland

Some of our providers are based in the European Union or the United States. Transfers take place on the basis of the European Commission's Standard Contractual Clauses and the recognition decisions issued by the Swiss Federal Council.

Your rights

Under the Swiss Federal Act on Data Protection and, where it applies to you, under the European GDPR, you have the right to:

Ask what data we hold about you, and receive a copy of it
Have inaccurate data corrected
Have your data deleted, where no legal obligation requires us to keep it
Object to a given processing operation, or ask us to restrict it
Receive your data in a portable format
Withdraw your consent at any time, without affecting what was lawful before

If you believe your data has been handled improperly you can complain to the Swiss Federal Data Protection and Information Commissioner (FDPIC), or to the supervisory authority of your own country if you are in the European Union.

Changes to this policy

If this policy changes, the new version is published on this page with an updated date. If the change is substantial and affects people we already work with, we tell them by email.
